Penalties

A DWI charge is taken seriously in the state of Minnesota. The legal limit of blood alcohol content (BAC) is .08%, but you can be arrested for less if police can prove that alcohol or drugs caused you to commit serious driving errors.

The DWI penalties in Minnesota are severe and can range from misdemeanor fines to felony convictions and jail time, not to mention lengthy license revocations. All DWI drivers’ license revocations will require a $690 reinstatement fee in addition to a DWI knowledge test, DL application fees, and chemical assessment.

  • The degrees of offenses are as follows:
  • First DWI - Misdemeanor Fourth Degree DWI
  • Second DWI offense within past ten years – Gross Misdemeanor
  • Third DWI Offense within past ten years – Gross Misdemeanor Second Degree DWI
  • Fourth or more DWI Offense within past ten years – Felony First Degree DWI

If a driver is arrested in four different occasions for a DWI in a period of 10 years, or if a DWI driver has been previously convicted of a felony DWI involving serious injury or death, the driver can be charged with a felony.

Criminal penalties for a felony DWI can be as long as seven years in prison, following a five year conditional release and $14,000 fine.
